Is CharityTracker legal?

  • The United Way of Northwest Alabama was a key player in the creation of CharityTracker. Before they allowed the system to be used by their member agencies, they sought legal counsel. The program and it's documentation were reviewed by a lawyer to ensure compliance with HIPAA, federal, and state laws.

  • CharityTracker has been vetted by many organizations before they began using the system. It has met the standards for use every time.

  • CharityTracker was reviewed by the Alabama Attorney General's office and approved for use by DHR and DHS.

  • Several DHS and DHR offices in the US are using CharityTracker.

  • CharityTracker 's database technology and security is HIPAA certified. It uses 128-bit encryption and is audited three times a year by an independent security firm to ensure continued security and HIPAA compliance. These are the same security standards utilized by banks and the Federal government.

  • The Vice President of Membership Accountability at the United Way of America has reviewed CharityTracker. We have a long-standing relationship with almost 30 local United Way and 211 offices in the US.

  • CharityTracker uses the same technology and methodology employed by our competitors. If information sharing were illegal, then the entire HMIS industry would be in violation of the law.

  • Sharing information is not illegal. Information sharing is used in every industry from banking, credit, education, media, and even movie rental outlets. While there are guidelines for sharing information, as long as organizations adhere to the CharityTracker Terms of Service, then they are in complete compliance with the law.
